CIS tax returns
The Construction Industry Scheme is HMRC's mechanism for collecting tax from construction subcontractors at source. A contractor paying a subcontractor for construction work must verify them with HMRC, deduct 20% from the labour element of the payment if they are registered or 30% if they are not, pay the deduction to HMRC and report it on a monthly return. The subcontractor then reclaims the deductions against their actual tax liability through Self Assessment, or for a company through its PAYE account. Because deductions are a flat percentage of turnover while tax is charged on profit after expenses and allowances, most subcontractors have overpaid by the year end and are owed a refund.

In detail
How cis tax returns works
Our subcontractor service is built around that refund. For £149 we prepare the full Self Assessment, reconcile every deduction statement to the income it relates to, claim the expenses that construction trades commonly miss, such as tools, protective clothing, travel between sites, van costs and use of home for administration, and calculate the repayment. The return is filed as soon as you approve it, and because HMRC processes CIS refunds in order of receipt, filing in April or May rather than January typically brings the money weeks earlier. Where several years are outstanding, returns for up to four years can be filed together and the refunds offset against any late penalties.
Contractors have the monthly obligation. The CIS300 covers payments made in the tax month to the 5th and must be filed by the 19th, with a deduction statement to each subcontractor by the same date; a nil return is still required in a month with no payments. Late filing penalties start at £100 and escalate. Our £30 a month service verifies every new subcontractor, applies the rate HMRC specifies, splits labour from materials correctly, files the return and issues the statements. Since 2021 the domestic reverse charge has added a VAT dimension: where both parties are VAT and CIS registered, the subcontractor invoices without VAT and the contractor accounts for it, and we check every CIS client's invoices in both directions for this.
Limited company subcontractors work differently from sole traders. Deductions suffered by a company cannot be reclaimed through a personal return; they are set against the company's own PAYE and CIS liabilities month by month through the Employer Payment Summary, and any balance remaining at the year end is reclaimed from HMRC in writing or offset against Corporation Tax. The company must therefore run a PAYE scheme even if the only employee is the director, which is why our CIS plus payroll bundle at £49 a month exists. Getting this mechanism wrong is the most common reason companies in construction find themselves owed money by HMRC that they do not know how to recover.
The way out of deductions altogether is gross payment status. A subcontractor with gross status is paid in full and settles their tax through the normal Self Assessment or Corporation Tax cycle, which transforms cash flow for an established business. HMRC applies three tests: a construction turnover of at least £30,000 net of materials for a sole trader, or £30,000 per director for a company with a £100,000 alternative; a compliance test looking at the previous twelve months' filings and payments across all taxes; and a business test requiring a UK bank account and genuine construction trading. Our £199 service assembles the evidence and makes the application, and we tell you honestly beforehand if the compliance record is likely to fail it, since a refused application cannot be repeated for twelve months.

Worth knowing

The Self Assessment calendar
Self Assessment runs on a fixed annual cycle. Registration by 5 October following the tax year, online filing and payment by 31 January, and a second instalment on 31 July for those making payments on account. The penalties for lateness are automatic and escalate monthly, which is why we file early and chase approvals well before the window closes.
Payments on account
Payments on account catch out most people in their second year of self-employment. HMRC assumes next year's tax will match this year's and collects half in January and half in July, in advance, on top of the balancing payment. If profits are dropping you can apply to reduce them, but reducing them too far attracts interest. We calculate the right figure rather than guessing.
Late filing penalties
Lateness is expensive in a way that compounds. For individuals, £100 immediately, then daily penalties, then percentage-based ones at six and twelve months, with interest running on unpaid tax throughout. For companies, Companies House penalties scale with delay and double on repeat, and HMRC adds its own for a late CT600. Filing on time is the cheapest tax planning there is.
Making Tax Digital for Income Tax
The biggest change to Self Assessment in a generation is Making Tax Digital for Income Tax, now live for higher-earning sole traders and landlords and arriving for the rest in stages. Quarterly updates are due by 7 August, 7 November, 7 February and 7 May, built from digital records. The practical consequence is that spreadsheet-and-shoebox bookkeeping is ending for anyone above the threshold.
The VAT registration threshold
VAT registration is compulsory once taxable turnover in any rolling twelve-month period exceeds £90,000, or when you expect to exceed that in the next thirty days alone. The test is rolling, not by tax year, and includes zero-rated sales. Businesses regularly cross it without noticing, and late registration means accounting for VAT on sales where it was never charged to customers.
Corporation Tax rates and marginal relief
Corporation Tax is not a flat rate. Profits to £50,000 pay 19%, profits above £250,000 pay 25%, and the band between is taxed at an effective marginal rate of 26.5% through the marginal relief mechanism. Associated companies share the thresholds, which catches directors who own more than one company and is the most common cause of underpaid tax in owner-managed groups.
Salary versus dividends
Directors of their own companies usually take a salary at or just above the National Insurance thresholds, which keeps the year qualifying for State Pension and is deductible for Corporation Tax, with further income as dividends. Dividends above the £500 allowance are taxed at 10.75%, 35.75% and 39.35% by band and can only be paid from distributable profits after tax, with a minute and voucher each time.
Questions
CIS Tax Returns: your questions answered
What does the £149 subcontractor return include?
Your full Self Assessment with the self-employment pages, every CIS deduction statement reconciled to your income, allowable expenses claimed, the refund calculated and the return filed. We then track the repayment with HMRC, which usually arrives within two to six weeks of filing in the quieter months.
How much CIS refund can I expect?
It depends on your profit and expenses. Deductions are 20% of the labour element of your invoices; tax is only due on profit after expenses and the £12,570 personal allowance, with Class 4 National Insurance on top. Many subcontractors earning under £35,000 get back several thousand pounds. We give you the figure before filing.
When are contractor returns due?
The CIS300 monthly return covers the tax month to the 5th and must reach HMRC by the 19th. Deduction statements must go to subcontractors by the same date. A nil return is still required if you paid no subcontractors. Late returns cost £100 immediately, rising to £200 after two months and then percentage-based penalties.
What rate do I deduct from a subcontractor?
You must verify each new subcontractor with HMRC before the first payment. HMRC tells you 20% if they are registered, 30% if not, or 0% if they hold gross payment status. Deductions apply to the labour element only, never to materials, VAT or plant hire. We verify every new subcontractor and record the result.
What is gross payment status and can I get it?
Gross status means contractors pay you in full with no deduction; you pay your tax through Self Assessment or Corporation Tax instead. You need a construction turnover of at least £30,000 (sole trader) or £30,000 per director for companies, a clean compliance record for the previous 12 months and a UK bank account. Our £199 service prepares and submits the application.
How does CIS work for a limited company subcontractor?
Deductions suffered by a company are not reclaimed through Self Assessment. They are offset against the company's own PAYE and CIS liabilities each month through the Employer Payment Summary, and any excess at the year end is reclaimed from HMRC in writing. The £49 CIS plus payroll bundle handles this monthly.
How does the VAT reverse charge affect CIS work?
Since March 2021, where both parties are VAT and CIS registered and the supply is within the scheme, the subcontractor does not charge VAT; the contractor accounts for it on their own return. The invoice must state that the reverse charge applies. We check your sales and purchase invoices for this on every return.
Do I need to register for CIS?
Subcontractors should register so deductions are 20% rather than 30%; registration is free with HMRC or £49 through our service with your UTR sorted at the same time. Contractors must register before paying their first subcontractor. If you are both, both registrations are needed; our dual package is £99.
What counts as construction work under CIS?
Site preparation, building, alteration, repair, decoration, demolition, and installing systems such as heating, lighting and water. Professional work such as architecture and surveying, scaffolding hire without labour, and carpet fitting are outside the scheme. Mixed contracts fall within it entirely. We check borderline cases against HMRC's list.
What records do I need to keep for CIS?
Subcontractors: every deduction statement, invoices and bank records. Contractors: verification references, gross payments, materials costs, deductions made and the statements issued, for at least three years. Missing deduction statements are the most common reason refunds are delayed, so we help you obtain copies from contractors.
I have not filed for several years. Can you catch me up?
Yes. Late Self Assessment returns can be filed for the last four tax years to reclaim CIS deductions, and HMRC will offset refunds against any penalties. We quote a fixed fee for the set based on the number of years and reconcile each year's statements. The sooner this is done the more years remain claimable.
Can my CIS deductions be set against my VAT or other taxes?
For sole traders, no; CIS deductions are credited against your income tax and Class 4 National Insurance through Self Assessment, with the excess refunded. For companies, deductions are offset against PAYE and CIS owed, and the remaining balance is repaid by HMRC after the year end or, on request, set against Corporation Tax.
