Worth knowing
Rules that come up in this work
The VAT registration threshold
VAT registration is compulsory once taxable turnover in any rolling twelve-month period exceeds £90,000, or when you expect to exceed that in the next thirty days alone. The test is rolling, not by tax year, and includes zero-rated sales. Businesses regularly cross it without noticing, and late registration means accounting for VAT on sales where it was never charged to customers.
Director's loan accounts
Money taken from a company has to be something: salary, dividend, expense reimbursement or loan. If it is a loan and remains outstanding nine months after the year end, the company pays tax at the dividend higher rate on it until it is repaid. Clearing the balance with a properly declared dividend before the deadline, where reserves allow, is routine year-end work.
Salary versus dividends
The salary-and-dividend split is the central planning decision for an owner-managed company. Salary costs employer National Insurance above £5,000 but is deductible; dividends are not deductible but attract lower personal rates and no National Insurance. The optimum changes each April with the thresholds and depends on the director's other income, so it should be set deliberately every year.
Payments on account
A common surprise in Self Assessment is the January payment that is far larger than expected. That is the balancing payment for the year just ended plus the first payment on account for the year ahead, which HMRC sets at half of the bill just calculated. We put the figure in your hands months ahead and tell you how to adjust it legitimately when circumstances change.
The Self Assessment calendar
The tax year runs from 6 April to 5 April. Anyone new to Self Assessment must register by 5 October after the end of the tax year in which their untaxed income began. The online return and the balancing payment are due by 31 January, with a second payment on account on 31 July where they apply. Paper returns have an earlier deadline of 31 October and are rarely sensible.
Making Tax Digital for Income Tax
Making Tax Digital for Income Tax began in April 2026 for sole traders and landlords with qualifying income over £50,000, extends to those over £30,000 in April 2027 and is planned for £20,000 in April 2028. It requires digital records in compatible software and four quarterly updates to HMRC each year, with a final declaration replacing the traditional return. Payment dates are unchanged.
Late filing penalties
Penalties are the clearest reason to work to deadlines. A Self Assessment return one day late costs £100 regardless of whether any tax is due; three months late adds £10 a day. Late company accounts start at £150 and reach £1,500, and double if the previous year was also late. None of this is negotiable afterwards except through a narrow reasonable-excuse appeal.
Questions
HMRC Investigation Support questions from Fairlop
I received a nudge letter but I think my return is right. What should I do?
Nudge letters ask you to check and either amend or confirm. Do not sign HMRC's certificate without checking thoroughly, because signing a false one is serious. We review the area HMRC has raised, confirm the position and respond. If the return is right we say so to HMRC clearly; if not, we amend before any enquiry is opened.
Can I pay what I owe in instalments?
Usually. HMRC's Time to Pay arrangements spread settlements over months, sometimes years, depending on the amount and your means. Interest runs but further penalties do not if you keep to the agreement. We negotiate the arrangement as part of closing the enquiry, with realistic figures based on your income and assets.
How long does an enquiry take?
A straightforward aspect enquiry into one item can close in two to three months. A full enquiry into a year's records typically takes six to twelve months, longer if HMRC extends to other years. We keep the process moving by responding within deadlines and pressing HMRC to do the same, and we apply for a closure notice if HMRC stalls.
Should I just send HMRC everything they ask for?
No. HMRC is entitled to information reasonably required to check the return, and no more. Requests for private bank statements, several years of records or information about other people are often wider than the law allows. Giving too much lengthens the enquiry and can open new lines. We give HMRC what it is entitled to, promptly and completely.
What does the £299 first stage cover?
Reviewing HMRC's letter and the return or period concerned, assessing what HMRC is likely to be looking at and your exposure, arranging agent authorisation, and preparing and sending the first response within HMRC's deadline. At the end you know where you stand and what the next stage would cost, and you decide whether to proceed.
What is the difference between a compliance check and an investigation?
A compliance check is HMRC's standard term for any review of a return, from a single question to a full examination of a year's records. Most are routine. A Code of Practice 9 investigation is reserved for suspected serious fraud and works very differently, offering immunity from prosecution in return for full disclosure. We tell you which you are facing from the letter.
